IY2q lY uY lu: C18 ruitC`(' t.aw urr aueo c. .. .. ...., ~._ <br />CQI~1~.1«3$ C~YJI`dTY <br />RESOLUTION NO. ~- " ~ +{ ` ¢! <br />P.ESOLUTdOA' FOR THE d.~'~l.SE PdJRCHASE OFPdfOPERT~' <br />---_- -~~ <br />WHEREAS,; The county desires to acquire on a lease purchase basis certain property <br />from AUGUSTINE J. & MARGARET DeHERRERA FAMILY TRUST for the purpases <br />of operating a gravel pit and, <br />WHEREAS, C.RS. 33-11-107, et seq permits the Jeasepurchase of county helF ProPe~Y <br />and, <br />WHEREAS, it is in the best interest and welfare of the citizens of Conejos County to <br />acquire said property and. as the same being a fiscally sound purpose, <br />NOW, THEREFORE, BE 1T RESOLVED that Conejos County shall acquire on a lease <br />purchase basis, the same of even date her8with to be recorded with the Conejos County <br />Clerk and Recorder the AUGUSTiNE J. & MARGARET DeHERRERA FAMILY <br />TRUST property, to-wit, <br />TRACT 2 of the Conejos CountylAugustine J_ DeHerrera Division of <br />Land amended plat of tracts I and 2 recorded on April 22, 2004 under <br />reception #4000735 in the office of the Conejos County Clerk and <br />Recorder. <br />Except: TRACT 2 of the Conejos CountylAugustine J. DeHerrera <br />Division of Land, plat as recorded on December 7, 2000 at 12:13 p.m. <br />under reception #250001996 in the office of the Conejos County Clerk <br />and Recorder. Said exception is alYeady subjected to a lease purchase <br />agreement entered into as Conejos County Resolution C-46-00 dated <br />December 29; 2000: <br />The remainder of TRACT 2 of the amendled plat of tracts 1 and 2 (without the excepted <br />land) is the land subject to this lease agreement. Such land contains 20 acres mare or <br />less_ ~ c, <br />This Resolution was discussed and approved on th~~ day of 1) 1Ctc , 2004 <br />at a duly constituted meeting of the Board of County Commission <br />
