<br />LEAS <br />THIS LEASE is entered into this ~-day of~~ 2004, between AUGUSTINS J. & <br />Margaret DeHERRERA FAMILY TRUST, ("ownCf') and CONEJOS COUNTY, COLORADO <br />("lessee"). <br />I. DESCRIPT[QN: <br />A. The Owner rents and leases to The Lessee, to occupy and to use for INDUSTRIAL <br />GRAVEL PIT OPERATION AND EXTRACTION purposes, the following real estate located in <br />the County of Conejos, and State of Colorado, described as follows: <br />TRACT 2 of the Conejos County/Augustine J. DeHerrera Division of Land <br />amended plat of tracts 1 and 2 recorded on Apri122, 2004 under reception <br />#4000735 in the office of the Conejos County Clerk and Recorder. <br />Except: TRACT 2 of the Coaejos CountylAun sine T. DeHerrera Division of <br />Land, plat as recorded on December 7, 2000 at 12:13 p.m. under reception <br />#250001996 in the office of the Conejos County Clerk and Recorder. Said <br />exception is already subjected to a lease purchase agreement entered into as <br />Conejos County Resolution C-46-00 dated December 29, 2000. <br />The remainder of TRACT 2 of the amended plat of tracts I and 2 (without the excepted land) is <br />the land subject to this lease agreement. Such land comains 20 acres more or less. <br />B. Lease shall be from the date hereof to ApiiI I5, 2005, vsth automatic renewal for one <br />additional year to ead April I5, 20I4. <br />C.
