OTHER PERMITS AND LICENSES REQUIRED EXHIBIT M <br />The following permits aze needed for the site: <br />1) APEN - A fugitive air emissions permit is required from the Colorado Department of Public <br />Health and Environment since the site will mine more than 70,000 tons per yeaz. Air emissions <br />permits will be in place for all equipment utilized on site which requires a permit. An APEN <br />Permit is already in place with the CDPHE for the Colona Pit. <br />2) Gravel Well Permit - A Gravel Well Permit with the Colorado Division of Water Resources <br />must be obtained since the site will be reclaimed with 2 lakes. This permit includes an <br />augmentation plan and substitute water supply plan for the evaporation from the lake surface <br />created. This permit has been applied for. <br />3) C-DOT Access Permit has already been approved.
