plan requires leaving the lowest 2 feet of the gravel to avoid contact with the shale bedrock <br />below. <br />The operator commits to cleazly mazking the permit boundary with stakes surveyed on site. The <br />site will use all existing roads to haul the product to its final destination. It is planned that the <br />material maybe used to re-surface existing roads, make concrete aggregate or provide new road <br />base for any new roads within an economic distance to the site. <br />If any "reportable quantity" of hazazdous material or waste is released into the environment, the <br />operator will notify staff of the Colorado Division of Reclamation, Mining and Safety as well as <br />all other appropriate local, state and federal agencies. This is more completely described by an <br />excerpt from the February 8, 2002 DRMS memorandum regarding Minerals Program <br />Notification of Toxic or Hazardous Materials Spills at Mine Sites." <br />"A reportable spill is a spill of any toxic or hazadous substance (including spills of petroleum <br />products) within the permit azea reportable to any Division of the Colorado Department of Public <br />Health and the Environment, the national Response Center, the Colorado Emergency Planning <br />Committee, or the State Oil Inspector. The operator shall notify the Office of a reportable spill <br />within the permit azea using the same timeframe required by the permit, license, notice, Act, <br />Rule or Regulation governing the reporting of the spill to the appropriate agency. Notice of a <br />reportable spill shall be Faxed to: Minerals Program Supervisor, Division of Reclamation, <br />Mining and Safety, FAX (303) 832-8106. The FAX shall include acall-back number of a <br />responsible company official for the DRMS staff to use as a contact." <br />3. Site Draina¢e <br />The entire site drains to the inside of the pit, which is over 28 feet deeper than the surrounding <br />terrain. Any runoff from a storm is simply absorbed into the gravel and the groundwater system. <br />This will also be true when the lakes are created. Since no dischazge will occur from the site no <br />NPDES permit is needed. <br />Colona Pit November 06 D-10 <br />
