Minutes, June 24-25, ~2 <br />~ DRAFT <br />SubiectTo Board Apprm:~^I <br />In response to an inquiry from the Board, Staff said the Division is <br />still in the process of reviewing TR-006 which addresses the protocol <br />and third-party monitoring. Staff said the Division has not had an <br />opportunity to review the nominations for third-party monitoring and <br />could not make a recommendation to the Board for a selection at this <br />time. The Board clarified that the Division would make the decision <br />regarding the third-party monitoring provider. <br />... <br />During the June 25, 1992 portion of the Board Meeting, Mr. Frank <br />Johnson presented and discussed EXHIBIT A, a proposed Order to reflect <br />the Board's Motion and decision, regarding this matter. He said the <br />other parties had been provided with copies of the proposed Order. <br />The Board discussed and commented on the proposed Order, as follows: <br />Page 1, No. 5--clarified that the parties desired cessation of the use <br />of cyanide, unless levels below 4.4 were reached, and asked that the <br />last sentence be moved to No. 7; Paqe 2, No. 4--asked that the Order <br />reflect the Division's commitment to immediately shut down the <br />operation at any time it is felt that the operating levels were not <br />safe. Mr. Johnson clarified that this is stated in the May 1992 Order <br />and is covered in No. 2 of this Order; Page 3, No. 5(b), Dean <br />Massey--clarified that the October 15, 1992 deadline should be removed, <br />because previous testimony stated that levels of 4.4 and :1.8 would not <br />be reached until about 2 months after installation ~f the INCO <br />treatment system (the Board concurred with this information and asked <br />that "by no later than October 15, 1992" be deleted from the Order); <br />Page 3, No. 6, Dean Massey--said the current language i~ this Order <br />modifies the May Order (the Board asked that language be added to the <br />last sentence making it state "...with the exceptions of the cyanide <br />levels and compliance dates specified in this Order". <br />It was MOVED that the Board adopt the interim Order concerning <br />detoxification for Battle Mountain Resources, Incorporates, as amended <br />during this discussion. SECONDED AND PASSED UNANIMOUSLY <br />(Kraeger-Rovey, Stewart, Danni and Cattany); 1 abstention (Cooley); <br />Jouflas and Danielson not present for the vote. <br />. . . <br />At this time, the Director and Staff briefly discussed the July Board <br />Meeting. During that Meeting, an inspection of the Summitville mine <br />site will be conducted by the Board on July 23, 1992, anc this will be <br />published in the July 1992 Board Meeting Agenda. A record wilt be made <br />and an inspection report will be generated. <br />
