Box 1849 Division DlretYOr <br />Natural Resource Trustee <br />Grand Junction, Colorado 81502 / / <br />RE: Soaring Eagle Gravel Pit, Permit No. M-1999-025, Technical Revision No. 3 Adequacy Review <br />Dear Mr. Settle: <br />DMG completed review of your response to the preliminary adequacy review of your application for <br />Technical Revision No. 3 (TR-02) to Permit No. M-1999-025 for the Soaring Eagle Gravel Pit. The <br />application cannot be approved until the following remaining issues are adequately addressed. Please <br />submit a response to the following issues as soon as possible, but no later than February 3, 2006 so <br />the decision due date set for February 3, 2006 can be met. If your response or a written extension <br />request are not received by February 10, 2006 this application may be denied. <br />ADEQUACYISSUES <br />1. Response acceptable. <br />2. Response acceptable. <br />3. If the April 1, 2006 due date for submittal of engineered designs and financial warranty for the <br />inlet structure cannot be met, a report of progress made and an anticipated submittal date will <br />need to be submitted by that date. Failure to submit the designs by April 14, 2006 may leave <br />DMG no choice but to schedule a hearing before the Mined Land Reclamation Board for failure <br />to maintain compliance with conditions of permit M-1999-025. <br />4. Reclamation map contours indicate the 0.2 acre wetland mitigation bench proposed on the north <br />island is located at an elevation 9 to 11 feet above the specified water level of the post mining <br />lake. Please revise this map to show the wetland bench constructed at an elevation conducive <br />to establishment and long term productivity of a wetland. <br />5. The proposed reduction in acreage of current Phase VI (proposed to be Phase V) from 8.73 <br />acres to7.2 acres creates a discrepancy in permitted acreage and that shown on the revised <br />map. To correct this, please include the original boundary on the maps, labeled as the current <br />"permit boundary". Also keep the revised boundary labeled as the "affected area" boundary. <br />6. The recently recalculated reclamation cost estimate appears to remain accurate for reclamation <br />of the site.
