Gttany <br />Division Director <br />Natural Resource Trustee <br />This document applies to mining operations what the current permitted mice operator wishes to transfer the Reclamation <br />Permit and permitted reclamation responsibilities to a Successor Operator (a new operator). Please follow the instructions <br />provided in this package for filing an application; Mineral Rules and Regulations and Construction Material Rules and <br />Regulations Nuarber 1.12 (Permit Transfer application requirements) should aLgo be reviewed prior to completing this fomt. <br />.. :. s, <br />-- .~~ <br />To apply for a transfer please submit dre following to the Division of Minerals and Geology (the ODivisioa ^)• <br />1) A "Transfer of Permit and Succession of Operator" application form, signed a~ notarized by an authorized <br />representative of BOTH the cwreat permittce and sluxressor operator; <br />2) The Applicadoa Foe of 5100.00 for Hard Rock operations and 5125.00 for Construction Materials operations; <br />3) A Performance Warranty Form bearing an original notarized sigoaU>re of en authorized representative of the <br />successor operator; and, <br />4) Financial Warrmtty: <br />A) You have the option to WANE YOUR RIGHT to a thirty (30) day processing time to allow the Division <br />time to recalculate the required futancial warranty; or, <br />B) You may choose NOT TO WANE YOUR RIGHT to a thirty (30) day processing time. In such case, the <br />Divisi~ will recalculate the required financial warre<rty within sixty (b0}days front the decision date (the <br />date the permit is transferred to the Successes Operator}. The requittd RECLAMATION BOND COULD <br />BE SUBSTANTIALLY INCREASED at that time. [f the financial warranty is intxeased, you will than be <br />required to post the additional financial warranty. <br />This applicati~ package contvns the "Transfer of Permit and Succession of Operator" application form, and a Performance <br />Warranty form for your use. Rule 4.3 of the Mineral Rules and Regulations and Rule 4.3 of the Construction Material Rules <br />and Regulations describes the various acceptable Financial Warranty types.
