The Tenant shall pay, before delinquent, a21 <br />ehazges for electricity and other utility services used, rendered, <br />or supplied for the operation oP the Tower and Building. Dpon <br />request of the Tenant, the Landlord agrees to grant to Poudre <br />Vallay Ruzal Electric Association or other utility provider a <br />nonexclusive utility easement from County Road z3 to the Tower <br />Location Por the construction, installation, maintenance, repair, <br />and replacement of electric lines adequate to serve the Tower and <br />Building. The exact location of the utility easement shall be <br />reasonably determined by mutual agreement of the parties. <br />7, rJse pf Pram~,ees. The Tenant may use the Leased Premises <br />for the construction and operation of the Tower and Building and no <br />other purpose without the coriaent oP the Landlord. Tf the Tenant <br />desires to grant to other entities the right to use the Sower for <br />radio, cellular phone, or other purposes, the Tenant shall pay to <br />the Landlord one-half of all rent received by the Tenant as a <br />result of such use. The Landlord shall not be obligated to pay any <br />costs which may be incurred to upgrade the Tower to acaammodate use <br />of the Tower by any such third party. <br />a. ,Trash Disnosai. The Tenant shall not burn or incinerate <br />any rubbish, garbage, or debris at, in, or about the Property and <br />shah not permit any rubbish, garbage, or debris to accumulate <br />thereon. <br />9. ordinances. In the construction and operation of the <br />Tower and Building on the Leased Premisaa, the Tenant shall observe <br />and comply with all Laws, ordinances, and regulations of public <br />authorities having jurisdiction over the Property. <br />10. Installation and Maintenance of rmp~QVe*~ents. <br />(a) The Tenant may install upon the Leased Premises the <br />Tower, not to exceed five hundred (500) feet in height; guy wires <br />and anchoza; the Building, not to exceed two thousand five hundred <br />(2,500) square teat in size? a Pence around the Tower, Building, <br />and anchor points, which Penoa may be chain link, eight (a) feet in <br />height with barbed wire on top; and such.toilat facilities as may <br />be required by any governmental authority having jurisdiction over <br />the Leased Premises. <br />(b} The Tenant shall paint the Building a neutral or <br />earthtone color.
