This operation is located in Water District 51. <br />Dear Sir. <br />Please note thatattached is a copy of the Mining commission's. report on the site <br />described above. Our understanding is that the Mining Commission isn't required to <br />notify you about this site. This particular site is of grave concern to those of us that live <br />in the Cheat Divide Head Lettuce Colony that share the water table. I will be referencing <br />this report. <br />The water in the ponds mentioned in the report has, in time past (actually until 2 nights <br />before inspection when it was backfilled)had been pumped out of those ponds and used <br />by the operators of this pit. We believe if they aze going to use water out of the ground in <br />that pit they need a well permit The operator claims they are using another water right <br />from an adjacent landowner. If that is correct we feel it should go through the water <br />court so that it can be administered by the water commissioner in district 51. We have <br />not been able to obtain any record of change of use of this water.
