11. Aesthetic and Recreational Concerns: "...the expanded operation of the gavel <br />pit will cause a substantial increase in noise. Likewise, the forecasted increase <br />in truck (and other vehiculaz) traffic will inevitably result in increased dust, <br />which will reduce visibility and impair the ability to enjoy the azea." WITNESSES AND EXHIBITS <br />Pursuant to Construction Materials Rule 2.6(2), all parties must exchange witness and exhibits at <br />the Pre-hearing conference. A copy of each list is attached. <br />All documents, exhibits and photographs admitted by the Boazd as evidence at the Formal Public <br />Hearing will become part of the administrative record. Upon request, a party may recover any <br />evidence introduced by that party, if no action for judicial review is commenced within thirty <br />(30) days of the date agency action in this matter becomes effective. <br />VI. PROCEDURE <br />The Division, parties and members of the public shall make presentations in the following order. <br />The time limits set out below are maximum limits and shall be strictly enforced. The Boazd, in its <br />discretion; may allow additional time when warranted. The Boazd has the right to limit any <br />redundant or irrelevant testimony. As noted below, all parties will be afforded an opportunity to <br />conduct cross-examination of any witnesses that testified during the presentation. <br />Boazd's Consideration and Adoption of the Pre-hearing Order <br />The Pre-hearing Conference Officer shall present this Draft Pre-hearing Order to the <br />Boazd for adoption. The Board will hear any objections to the proposed Order at that <br />time, and will make any necessary amendments prior to adopting the Order. <br />The Objectors intend to contest the Draft Pre-hearing Order. The Objectors believe the <br />list of issues not believed to be within the jurisdiction of the Boazd listed in Section IV <br />should be considered based on the Legislative Declazation in §34-32.5-102(1). <br />All parties in attendance at the Pre-hearing conference agreed that if the Board decides to <br />consider these issues the January 2007 formal Board hearing on this matter will be <br />continued until the Mazch 2007 Board meeting. A second pre-hearing conference will be <br />held prior to the March 2007 Boazd hearing to allow parties an opportunity to evalute the <br />additional issues, resubmit a list of witnesses and exhibits and to revise the procedural <br />time allotments. <br />The Objectors shall have 10 minutes for their presentation on the Draft Pre-hearing <br />Order. <br />
