WITNESSES AND EXHIBITS Pursuant to Construction Materials Rule 2.6(2), all parties must exchange witness and exhibits at the Pre-hearing conference. A copy of each list is attached. All documents, exhibits and photographs admitted by the Boazd as evidence at the Formal Public Hearing will become part of the administrative record. Upon request, a party may recover any evidence introduced by that party, if no action for judicial review is commenced within thirty (30) days of the date agency action in this matter becomes effective. VI. PROCEDURE The Division, parties and members of the public shall make presentations in the following order. The time limits set out below are maximum limits and shall be strictly enforced. The Boazd, in its discretion; may allow additional time when warranted. The Boazd has the right to limit any redundant or irrelevant testimony. As noted below, all parties will be afforded an opportunity to conduct cross-examination of any witnesses that testified during the presentation. Boazd's Consideration and Adoption of the Pre-hearing Order The Pre-hearing Conference Officer shall present this Draft Pre-hearing Order to the Boazd for adoption. The Board will hear any objections to the proposed Order at that time, and will make any necessary amendments prior to adopting the Order. The Objectors intend to contest the Draft Pre-hearing Order. The Objectors believe the list of issues not believed to be within the jurisdiction of the Boazd listed in Section IV should be considered based on the Legislative Declazation in §34-32.5-102(1). All parties in attendance at the Pre-hearing conference agreed that if the Board decides to consider these issues the January 2007 formal Board hearing on this matter will be continued until the Mazch 2007 Board meeting. A second pre-hearing conference will be held prior to the March 2007 Boazd hearing to allow parties an opportunity to evalute the additional issues, resubmit a list of witnesses and exhibits and to revise the procedural time allotments. The Objectors shall have 10 minutes for their presentation on the Draft Pre-hearing Order.
