ISSUES <br />Presentations to the Boazd shall be limited to the following issues. The parties shall limit <br />presentations to the question of whether the pending application should be approved or denied, <br />based on the issues stated below. <br />1. Is the financial warranty set at a level which reflects the actual cost of fulfilling <br />the requirements of the reclamation plan? (Rule 4.2.1, §34-32.5-117(4)) <br />2. Do all aspects of the mining and reclamation plan take into account the safety and <br />protection of wildlife on the mine site specifically with respect to the Columbian <br />sharptail grouse and the Greater sage grouse? (Rules 3.1.8 and 6.4.8) <br />Has the Applicant demonstrated compliance with applicable water laws for the <br />Morse Ditch water right? (Rule 3.1.6) <br />
