Lat1Ar, being first duly sworn upon oath, deposes and <br />says: <br />1. He is the Vice President of McAtee Construction Company, <br />a Colorado Corporation, and is empowered to act for and on behalf <br />of said partnership in all respects in connection with any appli- <br />cations, petitions, contracts, correspondence, bonds or activities <br />with or before the Colorado Mined Land Reclamation Board. <br />2. The surface and mineral rights in and to the property <br />known as the Harley Pit #1 is owned by Robert G. Harley, et al. A <br />copy of a lease between McAtee Construction Company and the owners <br />is available for inspection at the offices of the Corporation in <br />Sterling, Colorado. <br />3.
