RECEIVED <br />JUL 2 4.2002 <br />.ruly zz, 2ooz <br />Division of Minerals and Geology <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: <br />Inc., dba <br />To the Members of the Mined Land Reclamation Board: <br />pivision otMinerals and(Geology/ v <br />/h~y'¢L /1 (2 <br />v~ <br />I would like to ask that the Board withhold granting the Oldcastle SW Group further <br />additions to their present permit as they and the past operators of the pit (Palisade <br />Construction and Bill Bailey Construction) have not fulfilled their obligations for the past <br />22 years, for the following reasons: <br />1) The pit elevation has been mined deeper than the permit allowed as it <br />was originally supposed to align up with the future Berry Subdivision. <br />2) They presently are not able to keep their storm water contained within <br />their property causing problems with the Meeker Town Ditch and <br />depositing alkali and calcium residues on neighboring property <br />owners. <br />3) Absolutely no weed spraying has taken place in the past and is <br />evidenced in weeds overrunning their overburden stockpiles. This pit <br />is located in the problem area identified by Rio Blanco County as <br />producing the noxious weed leafy spurge. <br />4) The 4`h and final problem is that they and the past operators of the <br />Berry Pit have done little or no reclamation to this point on the present <br />20 acres that they have mined to date, and T question if they aren't <br />already working out of their 9.9 acre permit, and they are asking for 3 <br />or 4 times more acres before fulfilling their obligations on their present <br />pit. <br />Thanks, ~ <br />G%g~G~~ <br />Carl O.
