September 9, 2002 <br />Sue Grabler <br />Manager of Industry & Public Projects <br />Union Pacific Railroad <br />1400 West 52nd Avenue <br />Denver, CO 80221 <br />RE: Railroad Crossing Improvements for Hogue Gravel Pit -Steamboat Springs, CO <br />Dear Ms. Grabler, <br />This letter is in reference to Contract No. 30964 between Union Pacific and Duckels <br />Construction, Inc. for Private Way use at mile post 195.57 west of Steamboat Springs, CO. It <br />was brought to our attention by Routt County Planning Department, upon renewing our Special <br />Use Permit with Routt County, that you would require improvements at the above referenced <br />crossing. Issuance of this permit was tabled in part due to these required improvements until <br />October 3, 2002. The Planning Commission has asked that we have an agreement with Union <br />Pacific for this crossing before they will issue a renewal for our Special Use Permit. <br />On September 9, 2002, you informed us that an estimate for the improvements and an agreement <br />would not be possible by October 3, 2002, the date of our next meeting with the Planning <br />Commission. At this time we are requesting a letter from you stating that Duckels <br />acknowledges improvements are required for this crossing and as soon as an agreement is <br />available Duckels will sign the agreement and have the improvements completed. We would <br />also like to state at this time that the owner of the property known as the Hogue Pit would like <br />the crossing removed upon completion of the mining operation. <br />Sincerely, <br />Duckels Construction, Inc. <br />Fred A.
