Rationale for Recommendation for Approval Over Objections, Regulaz 112 Construction <br />Materials Permit Amendment Application, Rocky Mountain Materials & Asphalt, Inc. <br />Penrose Ranch Pit, M-1992-016 <br />May 9, 2003 <br />Introduction <br />On May 9, 2003 the Division of Minerals and Geology (DMG) issued its recommendation for <br />approval of Rocky Mountain Materials & Asphalt, Inc.'s amendment application, over <br />objections. This document is intended to explain why the DMG was able to recommend approval <br />over the various concerns and expressed objections to approval. <br />Rocky Mountain Materials & Asphalt, Inc.'s amendment application was found to be <br />administratively complete and considered filed with the Division on January 21, 2003. Pursuant <br />to Rule 1.6.6, the applicant was required to publish a new public notice due to a significant error <br />in the initial public notice. As a result, the comment period did not expire until Apri18, 2003 and <br />the 90-day review period expires on May 22, 2003 The application proposes to expand the <br />affected land area from 236 acres to 2496 acres and to mine the permit area in 100 acre phases. <br />The surface and mineral rights aze privately owned. <br />Objections <br />The Division received timely objections from the following person during the public comment <br />period. <br />Objector Dated Date Received <br />Ms. June A.
