C~-ooa- : t~,~wr~ ~h{-( <br />Long Term Flood Control/Mitigation Plan -Clarification of Commitments. <br />Dear Tom: <br />As you requested, Vana Companies, Inc. (VCI) is providing this letter to summarize our commitment to <br />incorporate into the Durham Pit Permit a long term Flood Control/Mitigation Plan. The Flood <br />Control/Mitigation Plan will address the following issues and include the following items: <br />A. Assurance that any potential for off site impacts will be minimized; <br />B. Adherence to all Federal, State, and Local floodplain laws and regulations; <br />C. An itemized summary of construction items and costs; and <br />D. A time schedule for completion of the plan. <br />So as to minimize the potential for any predicted adverse off site impacts; adjustments to the existing <br />berm will be completed by Mazch 30, 2005. Adjustments to the berm aze required to remove any existing <br />condition rises of the predicted 100-year water surface elevations on insurable structures. The <br />adjustments to the berm will be accomplished provided that local and federal floodplain regulations will <br />not be compromised. <br />The Flood Control/Mitigation Plan will be included in a Conditional Letter of Map Revision (CLOMR) <br />submittal to Weld County and the Federal Emergency Management Agency (FEMA). The CLOMR <br />submittal will begin the process of obtaining local and federal approval of the long term Flood <br />Control/Mitigation Plan for the Durham Pit. The Flood Control/Mitigation Plan will be submitted to the <br />DMG as previously stated as a technical revision by March 30, 2005. Attachment A to this letter is an <br />anticipated schedule for the completion of the Flood Control/Mitigation Plan. VCI anticipates and will <br />commit to the completion of construction for the long term Flood Control/Mitigation Plan by December <br />31, 2005. <br />If you have any questions regazding our commitment to the successful completion of this Flood <br />Control/Mitigation Plan please give me a call.
