The issuance of the <br />permit does not assure the applicam that no injury will occur to another vested water right or preclutle another <br />owner of a vested water right from saeKing relief in a civil court action. <br />2) The 7bnstructlon of this well shall be in compliance with the Water Well Construction Rules 2 CCR ao2-2, unless <br />approval of a variance has been granted t7y the State Board of Examiners of Water Well Construction and Pump <br />Installation Contractors in accordance wrth Rule 16. <br />3) Approvetl pursuarn to CR5 37.90.137 (2) and (11) far the construction antl operation of a well (gravel pit) exposing <br />antl diverting ground water tributary to the Gunnison River at a point where water is available for appropdatlon. <br />4) The approval of this permit does not grant a water dgM. This well (gravel pit) is sutlject to administration by the <br />Division Engineer in accordance with applicable decrees, statutes, rules and regulations. <br />5) The average annual amount of ground water to t76 appropriated shall not eXCeetl 2063.6 acre-feet wdh the total <br />surtace area of the proposed ground water pond limited to 14 acres. <br />6) The use of ground water, in add'nion to evaporation (a8.3 acre-feet/year), is limited to industrial use/dust control <br />(1a acre-feet/year), product moisture loss (9 acre-fe7tttyear), and dewatering (1992.3 acre-feet/year at 1900 gpm). <br />7) The owner shall mark the well (gravel pit) in a conspicuous place wr1lt wetl permk numbers} and court case <br />number(s) aS appropNete. The owner shall take necessary means and precataions to preserve these markings. <br />8) The provision of the Minimum Construction Standards in Rule 10 shall be waivetl for gravel pits except for Rules <br />10.1 and 10.2.1 regarding aquifer oornaminarltS. The owner of the gravel pR shall take necessary means and <br />precautions to prevent cornaminants from emedng the grevel pit well. <br />9) The owner shall submit, after inftiation of excavation, plan and cross section drawings on a-1/2' x 11' paper <br />showing the extent Of excavation, the maximum depth of the pit, antl the inklal static water level. <br />10) The boundaries of the gravel pit pond shall be more titan 600 feet from any existing well unless a hearing is held, <br />or waivers are obtained.
