. a III III III IIIIIII III ~ i a- r5-Q`( <br />BEFORE THE COLORADO MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />PREHEARING ORDER <br />IN THE MATTER OF BATTLE MOUNTAIN RESOURCES <br />File No. M-88-112 <br />Pursuant to 34-32-115(1) the Mined Land Reclamation Board ("Board"') has <br />determined that there is sufficient cause to warrant a hearina_ on this <br />matter. In order to provide an orderly proceeding, the Board hereby orders <br />the parties to comply with the following schedule for the submittal of <br />materials pertinent to the San Luis Project permit amendment appl•~cation: <br />December 19, 1989: Division will provide Battle Mountain, objectors <br /> and The Costilla County Courthouse with an <br /> adequacy review of the amendment app"ication. <br />December 29, 1989: Any objector who wishes to have party status in <br /> the proceedings and hearina must fil<o a written <br /> request setting forth a plain statement of the <br /> facts which entitle him to be admitted and the <br /> matters which he claims should be de<•ided by the <br /> Board (C.R.S. 24-4-105(211. Only those issues <br /> under the jurisdiction of the Board, and which <br /> are pertinent to the permit amendment. <br /> application, will be considered by the Board. <br />January 5, 1990 The Division shall provide each party with a <br /> complete list of parties to the proceeding. <br />January 9, 1990: Battle Mountain will provide the Division, <br /> parties and Costilla County Courthouse with <br /> responses to the adequacy review. <br />January 9, 1990 The Division will provide the parties with a <br /> tentative list of the issues to be considered. <br />January 16, 1990 The parties will provide the Division and Battle <br />Mountain with their responses to the Battle <br />Mountain January 9, 1990 submittal. The Division <br />will take these responses into consioeration when <br />formulating its proposed decision. <br />
