Memorandum of Understanding - the BLM and the MLRD r June 28, 1984 n u This Memorandum of Understanding is entered into among the Bureau of Land Management, United States Department of the Interior, acting by and through the State Director, Colorado State Office, the Bureau of Land Management ("BLM"), and the State of Colorado, acting by and through the Department of Natural Resources ('_Department") and the Colorado Mined Land Reclamation Board ("Board", "CMLRB"). I. Purpose The purpose of this Memorandum is to promote Federal-State coordination to reduce unnecessary duplication in the regulation of prospecting and mining operations for locatable minerals on public lands. This Memorandum applies to operations on public lands under the General Mining Law, 30 U.S.C section 22, et sea., to which 43 CFR 3800 applies in connection with the General Mining Laws and which are subject to C.R.S. 34-32-101 et sea. The BLM 43 CFR 3809 regulations include a provision for joint Federal-State administration and enforcement. C.R.S. 34-32-101 et sec. provides for and indicates the need for coordination with Federal agencies having jurisdiction over mining operations. BLM will continue administration of 43 CFR 3802 regulations (Exploration and Mining, Wilderness Review Program). II. Authorities This Memorandum is based on the following authorities: A. BLM 1. 43 U.S.C. 1201. -- 2. 1872 Mining Law as amended (30 U.S.C. 22, et sea.). 3. Federal Land Policy and Management Act of TJio ((sec. 302, 303, 601, and 603). 4. 43 CFR 3809 3-1 (c). B. Colorado 1. C.R.S. 1973, section 34-32-101 et sea. 2. Colorado Mined Land Reclamation 3oard Regulations 2 C.C.R. 407-1. III. Understanding The parties mutually affirm that they will comply with all provisions of this Memorandum. Nothing in this t~~emorandum should de construed as abrogating the authority of either of the far*_ies.
