<br />THIS DEED, made this 'day of September 2003, between TIMOTFIY J. P. LAING
<br />and RODNEY WAYNE LAING, Grantors, and the CITY AND COUN"fY OF DENVER, acting
<br />by and through its BOARD OF WATER COMMISSIONERS, a municipal corporation duly
<br />organized and existing under and by virtue of the laws of the State of Colorado, and THE
<br />SOUTFI ADAMS COUNTY WATER AND SANITATION DISTRICT, a Colorado Special
<br />District, Graotees, whose address for the purpose of this transaction is 1600 West 12°i Avenue,
<br />Denver, Colorado 80204,
<br />WITNESSETH:
<br />That the said Grantors, for and in consideration of the sum of SEVEN IiUNDRED
<br />NINETY THOUSAND DOLLARS ($790,000.00), and ocher consideration as set forth in the
<br />Purchase and Sale Agreement dated August 18, 2003, the receipt and sufficiency oC which is
<br />hereby acknowledged, have granted, bargained, sold and conveyed, and by these presents do
<br />grant, bargain, sell, convey and confine, unto the Grantees, their successors and assigns Corever,
<br />all right, title, interest, and ownership in the following described parcel of land including all
<br />sand, gravel and other minerals in and on such parcel situate, lying and being in the County of
<br />Adams and State of Colorado, to wit:
<br />A parcel of land located iu the South I-calf of the Southeast Quarter of the Northwest
<br />Quarter of Section 3, "Cownship 2 South, Range 67 West oC the 6°' P.M., being more
<br />particularly described as follows:
<br />Beginning at a point in the North line of said South Half of the Southeast Quarter of
<br />the Northwest quarter which is 30.0 Ceet East of the Northwest comer oC said South
<br />H~df of the Southeast Quarier of the Northwest Quarter; thence S 0"30' W parallel
<br />with the West line of said South Half of the Southeast Quarter of the Northwest
<br />Quarter, a distance of 377.3 feet; thence N 89°34' E parallel with the North line of
<br />said South Half of the Southeast Quarter of the Northwest Quarier, a distance of
<br />1059.63 feel to a point on the Northwesterly line of Brighton road; thence N 26"50' E
<br />along the Northwesterly line of Brighton Road, a distance of 424.4 feet to a point on
<br />the North line of said South Elalf of the Southeast Quarter of the Northwest Quarter;
<br />thence S 89°34' W along the North line of said South Half of the Southeast Quarter of
<br />the Norwest Quarter a distance of 1248.27 feet, more or less, to the Point of
<br />Beginning, as shown on Denver Water drawing CAD ]0943-3, a copy of which is
<br />attached and made a part hereof as Exhibit "A."
<br />also known and numbered as 11691 Brighton Road, Henderson, Colorado 80640,
<br />together with all interests of Seller in vacated streets and alleys adjacent thereto, all
<br />easements and other appurtenances thereto, all improvements thereon and all attached
<br />fixtures.
<br />The purchase price includes certain warranties by Grantors as are more specifically
<br />described in the August 18, 2003 Purchase and Sale Agreement, and the warranties contained in
