It has taken me a bit of time to research this file because I wanted to
make sure that I was accurate in reporting to you what I have found. I have enclosed the pertinent
documents related to technical revision number two (TR~) with this letter for your files.
A review of the file documents reveals that the Division of Reclamation, Mining and Safety (DBMS)
approved TR-02 on April 13, 2007. TR-02 requires the operator to drill three monitoring wells and measure
the ground water levels in each of these wells for at least five quarters prior to the start of mining in the
approved amendment two (AM-02) azea. Subsequent to the water level monitoring for five quarters, the
operator was to supply the DBMS with a report that gave the DBMS information on the ground water
levels. Once the groundwater levels aze known, the DBMS will be in a better position to know what course
of action to take.
At the time and to the best of our knowledge, the operator is not in violation of the Colorado Land
Reclamation Act for the Extraction of Construction Materials and has met all the Board and permit
mandated time frames and deadlines that aze required. However, if you know of any deadlines that the
operator has disregarded that the DBMS has jurisdiction to enforce, please write us to let us know.
If you have any questions, please do not hesitate to call me at 303-866-3863.
Si rely,
i '
azl B.
