t .. •- ~ • <br />-2- <br />Milling operations have not yet begun at the San Luis project because water <br />rights have not been obtained by Battle Mountain. The reclamation permit <br />states that milling operations cannot commence until the operator demonstrates <br />that appropriate water rights have been obtained. The Water Court in Alamosa, <br />Colorado, will hear this matter in late November, 1990. <br />During the permitting process, the Division staff worked to incorporate as <br />many citizen concerns into the process as possible, However, the Mined Land <br />Reclamation Board is a technical body concerned with the successful <br />reclamation of mining sites. Many of the concerns the staff received were <br />issues which are resolved through the county planning commission, The Mined <br />Land Reclamation Board does not have jurisdiction over those local issues.
