On May 31, 2002, an extension of the decision date was requested and was approved on June 3, 2002. That <br />extension was for 90 days and moved the decision date to September 3, 2002. Most of the items in your adequacy <br />letter have been addressed but have not been submitted for your review. It was thought that everything would be <br />turned in at once. However, there is one matter that has not been completed and that is an objection to the well <br />permit. This objection was filed by an adjacent landowner, although she did not file an objection to the-Reclamation <br />Permit application. <br />No settlement has been reached on this well permit objection and therefore it will go to healing before the <br />Division of Water Resources. That hearing is set for 9:30 AM on August 27, 2002. Hopefully, resolution will be <br />achieved at that time. But if it isn't, it may be necessary to further extend the decision date or make a decision <br />contingent upon resolution of this well permit objection. Because everything else is essentially addressed, I propose <br />that after the August 27 hearing whatever is completed be submitted for your review. That way we can at least make <br />some progress toward making the decision on the permit, even though it is understood that a final decision may not <br />be possible until the well permit issue is resolved.
