An itemized cost for backfilIing of any stockpiled
overburden into the reclaimed lake as specified in Item 6 above will also need to be included.
Further, the de-watering cost of $7173 for 26.26 acres will need to be revised and expanded to
include the cost for de-watering a pit area with 800 linear feet of exposed, advancing highwall as
specified in Item 9 above. Please revise the reclamation cost estimate to include these changes as
well as the cost for reclaiming the flood control dike as noted above. Please respond.
6.4.13 EXHIBIT M -Other Permits and Licenses
Pre-Hearing Order Issue :One of the three (3) issues for Boazd Consideration listed in the
Division's February 2, 2004 Pre-Hearing Order is "Has the Applicant provided a statement
identifying which permits, licenses and approvals they will be seeking in order to conduct the
proposed mining operation?" VCI has provided an Exhibit M which lists five (5) sepazate
permits necessary as part of the proposed operation. Please review the exhibit provided and
revise, as necessary, to include any other permits & licenses or approvals (such as IVPDES
Permit, OSE Permits) needed to conduct the proposed operation. Please respond.
Once again, I will look forward to your response on or before July 5, 2004 to allow adequate time
for review before the July 12, 2004 decision date. Rule 1.8.1 states that changes and additions to
the permit application must be filed with the Division and the County Clerk and Recorder. The
applicant must also provide the Division with an affidavit or receipt demonstrating that the
change or addition was filed with the County Clerk and Recorder no later than the close of
business on the day the change was filed with the Division.
Please contact me at (303) 866-3567 if you have any questions.
Sincerely,
Thomas A.
