Impacts to Surface or Groundwater Systems: The Division has previously requested that <br />VCI provide a statement of whether the operation is or is not expected to directly affect surface <br />or groundwater systems. The outcome of whether the operation will or will not directly affect <br />surface or groundwater systems is dependent on the following factors: A) Whether the current <br />configuration of the existing flood control dike creates a potential for adverse offsite flooding <br />impacts during a major storm event or series of events, and B) Whether the maximum extent of <br />de-watering and excavation will be limited to no more than 73 acres at any one time. Please <br />respond. <br />26. Office of the State Engineer -Approvals Required :VCI has indicated that a Well Permit <br />application has been submitted to the Office of the State Engineer and is presently under review, <br />and that the Division will be kept informed of any developments pertaining to either the <br />Substitute Supply Plan or the Well Permit. Please provide written correspondence from the <br />Office of the State Engineer (OSE) which cleazly states whether VCI has secured all necessary <br />approvals for continuation of de-watering and dry mining activities at the Durham Pit, and <br />whether such OSE approvals pertain to a maximum of 73 acres of de-watered excavation or to <br />the expected 125 acre and 7 acre de-watered excavations. hi the event that OSE written approval <br />of the required well permit for the Durham Pit de-watering activities cannot be achieved by July <br />5, 2004 please provide an assessment of how and when VCI will resolve this concern. Please <br />respond. <br />27. Floodway Designation & Flood Control Dike -Compliance with Rule 3.1.6 : VCI has <br />petitioned the Division to agree as part of the approval of this Amendment application (AM-1) <br />that any subsequent and necessary revisions to Permit M-78-056 pertaining to the Floodway or <br />Floodplain be allowed as a separate technical revision. The Division requests that all currently <br />available and appropriate Floodway and Floodplain information for the affected land and <br />surrounding area be provided and evaluated to the extent that the applicant can clearly <br />demonstrate that the proposed mining and reclamation plan will comply with the requirements of <br />Rule 3.1.6, ie: 1) minimize disturbances to the prevailing hydrologic balance of the affected land <br />and of the surrounding azea, 2) result in a flood control dike/north shoreline that will not damage <br />adjoining property or conflict with water pollution laws, rules or regulations of the federal <br />government, the state of Colorado or with any local government pollution ordinances, and 3) <br />result in a flood control dike/north shoreline that is stabilized and protected so as to effectively <br />control erosion. <br />In response, the Division requests that VCI provide any relevant and available floodway <br />designations for the reach of the Cache La Poudre River in and near the Durham Pit. Such <br />floodway designation(s) whether current or old should include floodway boundaries, base flood <br />elevations, date(s) of designation, and the authorizing federal and/or state organization(s).
