(MCR) and THE STATE OF COLORADO (THE STATE), WITNESSETH: WriE.Rt;A5, MCR' has er.ecuted and delivered Coal ::ecla:nation Bond to the State of Colorado and rile United States/Office of Surface Mining Reclamation and Enforcement (OSMRE) for the principal sum of THREE MILLION DOLLARS (53,000,000), WHEREAS, MCR has executed and delivered to THE STATE that certain Deed of Trust for THREE MILLION TWO HUNDRED SEVEIv`TY- TWD THOUSAND FIVE HUNDRED DOLLARS (53,272,500) in favor of the Public Trustee of Garfield County, Colorado conveying certain lands therein described to be held in trust for the benefit of THE STATE and the United States of America, as surety, for the faithful performance by MCR of it's obligations to THE STATE and the United States (OSMRE) evidenced by said Bond, WHEREAS the parties desire by this Addendum to ratify, confirm and approve the said Bond and Deed of Trust as surety therefor, AGREED: THEREFORE IN CONSIDERATION OF THE PREMISES IT IS ;..
