Cattany <br />Division Director <br />Natural Resource Trustee <br />RE: Pre-Board Hearing and Objection to the Lafarge Riverbend Amendment Application <br />regarding Legal Right of Access, Lafarge West, Inc, ,Riverbend Operation, 112c Permit No. M- <br />2000-016, AM-01 ~ <br />Dear Ms. Morton: <br />On January 21, 2005 the Division of Minerals and Geology (the Division) received your objection to <br />the Lafarge Riverbend Amendment application, based on the contention that Lafarge had no legal right <br />to enter your property and no operational agreement to mine the property. <br />On Mazch 14, 2005, in response to the Division's adequacy review, Lafarge submitted a package of <br />responses and revised maps. In the text of the material Lafarge stated "The Morton property has been <br />removed from the permit boundary; the text and maps have been Modified accordingly. The concerns <br />of Morton and the Stevens have been eliminated; their objection has been rendered invalid." <br />On March 15, 2005 the Division notified you that since the area in question has been removed from the <br />application, it would appear that there is no longer a legal right of entry issue. The only other objector <br />to the application has formally withdrawn as an objector. As required by our roles, when there is an <br />objection to an application, the Division has scheduled aPre-Hearing Meeting. This meeting has been <br />scheduled for September 29, 2005, at 10:00 am at our office in Room 215 at 1313 Sherman Street, <br />Denver, Colorado. If you so desire the Division could attempt to conduct this hearing as a telephone <br />conference call, however, since it appears that your concern has been resolved, the Division would like <br />to know if you still wish to be a party and participate in a September 29, 2005 Pre-hearing and the <br />subsequent Formal Board hearing scheduled for October 12-13, 2005? <br />We would appreciate a notification if you do wish to remain a party and attend these hearings or a <br />written notice if you wish to withdraw as an objector.
