The Rule 1, 1.1 <br />defination of regulations under number 4 "Affected Lands" (All lands shall be excluded that <br />would be otherwise included-that reads affected lands shall not include off-site roads which <br />exist prior to the date on which notice was given or permit application) <br />Our situation is this...our permit area is 2.8 acres and we set the markers at 3.8 acres <br />allowing 1 acre for access roads in to and to cross the effected area or boundry area and to <br />be able to service the rest of our 160 acres. When you check it with a GPS such as Erica <br />Crosby did it puts us 1 acre over our 2.8 acre permit which makes us inviolation of our <br />contract. <br />Since you can't mine an existing access road, we feel we may not have to amend our <br />permit.
