The Dlvlslon request to facilitate the <br />settling of topsoil floes Into the voids negates that <br />purpose. <br />11. The Divisions arbitrary request, No. 11, that a tree pad <br />be installed and planted no later than July 31, 1994, is <br />In direct contradiction with Dlvlslon Request No. 10, <br />which requests that topsoil and fine material on the <br />tree pads be allowed to settle for a couple of years <br />before planting. It also ignores the facts of the site. <br />As stated In the original application, there will be no <br />sites available for permanent reclamation for about two <br />years. Attached is F"'~'2111ustrating the current <br />location of the limestone to be mined in Phase 1, and the <br />outline of the flyrock zone using a conservative 50 yards <br />distance In front of the blasts (and I would refuse to <br />sit anywhere near that close). As shown on the plan, the <br />first tree pad which can be installed on the strike ~~f <br />the formation, and which will have a reasonable drainage <br />area above It to supply water, is still two-thirds <br />unmined, with the remaining third in the flyrock zone:. <br />This area will be cleared within the next two years, and <br />reclamation by tree pad can be begun by that time. IJo <br />effective tree pads can be installed before that tlm~;. <br />12. As stated In the Addendum, the maximum disturbance before <br />reclamation !s started will be limited to 35 acres, that <br />ls, the present 30 acres of Phase 1, which, as shown <br />above cannot 6e reclaimed yet, plus 5 acres of road <ind <br />stripping into Phase 2, so that the limestone mining <br />operation can continue without Lnterruptlon when Pha:,e 1 <br />is completed. Thts disturbance will all be maJor <br />disturbance. As soon as the limestone mining is <br />completed in Phase 1, Reclamation Area 1, shown on ttie <br />Reclamation Sequence drawing can enter the reclamation <br />process, and start reducing the area not under <br />reclamation.
