I have discussed the question <br /> with Mr. Long,as well as with Ms. Cheryl Linden of the Attorney General's Office. It is the Division of Minerals <br /> and Geology's opinion that the technical revision process is appropriate for the change proposed by the operator <br /> and that it is not in conflict with the Statute or our Regulations. <br /> If in fact the Division finally approves the proposed technical revision and you disagree with the Division's <br /> decision, you have 60 days from the date of the Division's decision to appeal the decision. The Division was <br /> scheduled to make a decision on the TR on June 2, 1997. However, the operator has agreed to waive its right <br /> to a decision within 30 days, but we have not yet set a new decision date. <br /> The operator requested a waiver of the decision date,because the City of Boulder raised flood plain questions in <br /> their letter of May 13, 1997. The Division was not convinced that these questions could be adequately addressed <br /> by the information given in the submittal. The operator was not sure whether the questions could be answered <br /> within the existing time frame.
