Determination of Effluent Limitations <br />1. Discussion of Effluent Limitations <br />a. Regulations for Effluent Limitations: The Regulations for Effluent Limitations (Regulation No. 62), apply to <br />t/te conventional pollutants. For this facility the limitation for oil and grease is based on this regulation. <br />b. ADDlicable Federal Effluent Guidelines and Standards: Since no active mining is occurring, no federal <br />guidelines directly apply to this type of facility. <br />c. Flow Limitation: The permittee has entered into a consent agreement with the Division, which specifies how <br />tY.c ~ ~ r"hiration of Amer=can Tunnel flow and the flows in Czctem Creek u:.d frs tributaries will b^ routed <br />through the treatmentplant. The flow routing procedure may be relatively complicated and specification of <br />a single flow limit may not be possible. Therefore, only effluent flow reporting will be required. <br />d. Limits Based Upon Best Professional Judgment: The previous permits contained effluent limits for total <br />suspended solids and metals that were based upon the federal effluent regulations (BAT). And, the pH limit <br />was based upon a BPJ adjustment to the State Effluent Regulation limit, which resulted from the Division's <br />consideration of impacts to the receiving stream. <br />No active mining is currently occurring, nor is any mining expected in the future. Therefore federal BAT <br />limitations are not directly applicable. However, as a result of the consent decree between the permittee <br />and the state, the permittee will operate the treatment plant in the same manner as that which was done <br />during the term of the previous permits, and effluent concentrations will likety be similar to those discharged <br />in the past. The consent decree stipulates that the same limits for TSS, metals and pH contained in the <br />previous permits will be implemented in subsequent renewal permits. <br />e. AntideRradation: Since the receiving water is Use Protected, an antidegradation review is not required <br />pursuant to section 31.8(1) (b) of The Basic Standards and Methodologies for Surface Water. <br />
