Division personnel indicated that they had received a copy
of a letter addressed to Gold King from San Juan Corp. Stating that San Juan Corp was
terminating the lease to Gold King on the 5.67 acres of the Herbert Placer currently utilized for
the settling ponds of the American Tunnel Water Treatment Plant. Gold King has, as of now,
received no such letter or other notification.
Recently, San Juan Corp. has expressed some concems regarding certain documentation
not yet provided to it by Gold King as required in the lease. San Juan Corp. did send a "Demand
for Compliance or Possession" which was received by gold King on September 15, 2003 by
certified mail, with three days to reply. Gold King replied by Certified Mail on September 18,
2003 addressing all of the issues raised in the in the `Demand' as well as one additional issue
raised in a letter from San Juan Corp. Dated August 27., 2003.
Gold King is of the opinion that it has adequately and substantively addressed all of the
San Juari Corp. concerns and that the lease remains valid and in full force.
For your information, we are including a complete copy of our response to San Juan
Corp, including all of the attachments.
