25. For CR3 and CRS the applicant has committed to maintaining a 200-foot mining off set distance until <br />an agreement is obtained from Routt County. Please revise the mine plan map to reflect the <br />alternative 200 foot distance from the toe of the stockpile to the County Roads in the event such <br />agreements are not secured. If and when agreements are secured after the Division's decision on this <br />application, then the agreements must be submitted as a revision to the permit. <br />Under Rule 3.2(7) the Division is required to conduct an inspection prior to Board consideration. The <br />Division will schedule an inspection in late January of 2005. Additional questions may arise as a result of <br />the inspection. In addition, the Division will forward any comments received during the public comment <br />period from other agencies or concerned citizens. <br />Please be advised that King Mountain Sand & Gravel Pit Conversion Application may be deemed <br />inadequate, and the application maybe denied on February 21, 2005 unless the above-mentioned <br />adequacy review items are addressed to the satisfaction of the Division. If you feel more time is needed to <br />complete your reply, the Division can grant an extension to the decision date. This will be done upon <br />receipt of a written waiver of your right to a decision by Febmary 21, 2005 and request for additional <br />time.
