The Division of Minerals and Geology (Division) is
required to make an approval or denial decision no later than February 21, 2005, therefore, your response
to the following adequacy review concerns should be submitted to the Division as soon as possible.
1. Please submit the proof of notice to all owners of record of surface lands, mineral owners, easement
holders, and owners of record of surface lands that are within 200 feet of the boundary of the affected
land. The application is not cleaz as to the location of the topsoil stockpiles that will be used for final
reclamation. Please state if the topsoil piles are all or a portion the 6' high screening berm used to
minimize the visual impacts o£mining. The location of all topsoil piles will need to be depicted on a
map. in addition, please state if there will be any overburden piles and depict such piles on the
applicable map.
3. The screening berms have a proposed slope of 2h:1 v and are 6 feet high. Please state the method in
which the piles will be revegetated given the steep slopes and how they will remain stable for the
extent of mitring. In addition, please state the distance from the toe of the visual berms to the county
road and to the top of the pit.
4. The applicant proposes to mine the pit slopes at a 2h:ly and 3h:ly. Rarely does the Division see this
mining practice occur due to the difficult nature to mine in this fashion. Typically, the Division
observes slopes that aze mined at 1.Sh: I v. Please further explain how the operator will mine at these
slopes.
5. The applicant proposes a processing plant, an asphalt batch plant and a concrete plant on the site.
Please state if any ponds will be built to facilitate these structures. Tn addition, please state how the
structures will be constructed and maintained to minimize impacts to the hydrologic balance.
6. Please provide a description of all mining related structtues to be built on site so that the estimated
Frost for demolition can be included in the reclamation cost estimate.
