I used 124th Estates Partners, LLC ... and the purchase contract that I included was <br />signed by Dave Schultejann on behalf of the 124th Estates Partners, LLC, as a guarantor. I do not find 124th <br />Estates Partners, LLC to be registered with the Secretary of State ... so let me know what you need. I think <br />this is a resuh of the labor (me) not keeping track of the proper legal names and the misuse of '124th Estates <br />Partners, LLC' on the purchase contract. <br />Regarding the legal right to enter ... page 5 of the purchase contract is signed by the buyer. And, I was able <br />to include a clean unsigned copy of an Agreement to Amend/Extend Contrail ... and a very poor quality but <br />executed copy of the Agreement to Amend/Extend. The Agreement to Amend/Extend includes a statement <br />that all other terms and conditions ...shall remain the same. The real estate broker gets stern with me, saying <br />that this is a fully executed contract. <br />Item 'g' of the Additional Provisions of the purchase contract is meant to require the buyer to pay $15,000 per <br />month to the seller for an access easement across the property ... an easement which is to be granted when <br />the buyer purchases the "other" property (the small lot at 11061 E. 120th Ave.) ... Peter Schibli has purchased <br />this lot. <br />I apologize that there is confusuion regarding the Operator Name. Let me know what you need. And I am <br />sorry that the I did not explain the legal right to enter very well. Do we still need to clear up the relationships <br />of the different business entities and their authority to act for one another? <br />I am copying Dan Collyar, attorney for the Applicant, because he will likely need to help me, if a response is <br />needed.
