BEFORE THE COLORADO MINED LAND RECLAMATION BOARD COLORADO DEPARTMENT OF NATURAL RESOURCES THIRD REQUEST TO POSTPONE HEARING IN REGARD TO APPEAL OF OFFICE DECISION TO DENY REQUEST FOR ACREAGE REDUCTION IN THE MATTER OF PERMIT M-1987-049, AR-002 READY MIXED CONCRETE COMPANY By letter to the Office from Brierley & Associates dated December 6, 2004, this firm's client, Ready Mixed Concrete Company ("RMCC"), requested that the area covered by Permit No. M-1987-049 for its Bromley Lakes operations be reduced in size. The Bromley Lakes property is owned by the City of Brighton ("City"). RMCC owns, and is in the process of mining, the sand and gravel from the property. DMG representatives inspected Cell 1 on Tuesday, December 7, 2004 and subsequently denied the request by letter to RMCC of the same date. RMCC caused to be filed on December 7, 2004 an Appeal of Office Decision to Deny Request for Acreage Reduction. RMCC further requested that the matter be placed on the Mined Land Reclamation Board's ("Board's') December meeting agenda. The public hearing was thereafter continued to the Board's January meeting, and, subsequently, to its February meeting, upon request by RMCC. On Friday afternoon February 11, 2005, representatives of RPACC and the City reported to DMG staff by telephone on, among other things, the need for the Brighton City Manager and the Brighton City Council to approve the acreage reduction. The matter will be reviewed by the City Council only after the Board's February 15 meeting. Therefore RMCC requests that the public hearing be rescheduled and placed on the Board's March agenda.
