Cattany <br />Division DIltttOr <br />Natural Resource Trustee <br />Wellington Downs Pit; Permit No. M-1995-035 <br />The Division received Technical Revision 02 (TR-02) for the Wellington Downs Pit; Permit No. M- <br />1995-035 operated by Connell Resources, Inc. ("Connell"). Connell proposes to remove the planting <br />of trees and shrubs from the reclamation plan and retaining the temporary private driveway entrance <br />on site. The Division has the following comments regazding the revision; <br />1. Rule 6.2.1(2) requires that maps be signed by a registered land surveyor, professional engineer, <br />or other qualified person. The maps submitted to the Division were not signed. Please resubmit a <br />signed copy of the maps. <br />2. The operator proposing leaving an asphalt driveway 25 feet wide. Section 34-32.5-116(4)(a) of <br />the Colorado Land Reclamation Act for the Extraction of Construction Material states that grading <br />shall be carved on so to create a final topography appropriate to the final post-extraction land use <br />selected. Please further explain how leaving the 25 foot wide asphalt driveway will conform to the <br />approved reclamation plan. <br />3. Please state if any other roads will remain on site. If so, they will need to be noted on the <br />reclamation plan map. <br />4. Please inform the Division of the asphalt pad adjacent to the driveway will be reclaimed. <br />Please be advised that Division's decision due date is set for October 31, 29007. If you feel more <br />time is needed to complete your reply, the Division can gant an extension to the decision date. This <br />will be done upon receipt of a written waiver of your right to a decision by October 31, 2007 and <br />request for additional time. This must be received no later than the deadline date.
