Hart ~ Associates
October 29, 2004
Lt,.~ ~~
Ms. Kate Pickford ~•:.:.' ~ I ~Q~~
Colorado Division of Minerals and Geology _
1313 Sherman Street, Room 215 ~"•''""'~
Denver, CO 80203
Re: Aggregate Industries Technical Revision for Permit No. M-1989-029 (Distel
Operation)
Deaz Ms. Pickford:
This letter was prepared in response to your Adequacy Review for Aggregate
Industries (AI) Technical Revision (TR) for the Company's Distal sand and gravel
operation (DMG File # M-1989-029) dated October 4, 2004. Your letter identified four
"adequacy review concerns" that need to be addressed by the applicant before the
Division can make a decision regazding the above referenced TR. The following have
been prepazed in response to those concerns.
Concern No. I. "The cover letter included with the application indicates that "The revised
permit area is 712 acres, which is a net reduction of six (6) acres, and includes the
Longmont, Distel, Bigelow, Sherwood and Peschel properties. "Please be awaze that the
current, approved permit contains 530.3 acres. Please clarify this discrepancy. Also be
aware that in the event that the acreage in the permit is to be reduced, acreage has to be
removed from the permit through an application for acreage reduction."
Response: The 712 Acres identified in the cover letter to the Division was calculated
based on Exhibit B (see attached) titled "Index Map-Longmont Diste3 Operations" which
was included with a 112 permit amendment application submitted to the Colorado
Division of Minerals and Geology on September 11, 2000 and subsequently approved by
the Division in 2001. As stated on page six (6) of the approved amendment submittal,
"The proposed currently permitted azeas and expansion aze.as are shown on Exhibit B."
The 712 acre figure in TR-04 is based on the azeas identified as "Existing Operations
(Previously Permitted)" and "Proposed Expansion Areas" as shown on the enclosed
Exhibit B Index Map.
2155 Aleadvu~Avenue
P.O.
