Cattany <br /> Division DirecYOr <br /> Natural Resource Trustee <br />Re: Adequacy concerns, Amendment # 1, Permit # M-1983-106 <br />Dear Miss Crowell, <br />The Division has reviewed your 112 Amendment Application to expand the permit area for Permit # M-1983- <br />106 from the present 35 acres to 65 acres, and has the following concerns. <br />I) General <br />The application for the most part was adequate. The MLRD Board has adopted a policy that requires all <br />mining operators to provide a Noxious Weed Control Plan. If Cheyenne County has a Noxious Weed <br />Control Plan, please provide it. If not, please provide a statment, on how Cheyenne County plans to control <br />Noxious Weeds in the permit azea. <br />II) RULE 1.6.2 (d) requires all operators except 111 Special Operations, to publish a public notice in a <br />newspaper of general circulation. The Division has received a copy of your notice. In the notice you had <br />stated that, "comments must be in writing and must be received by the Division of Minerals and Geology <br />by 4:00 p.m. on August 20, 2003. The last publication date was June 26, 2003, THE LAST DAY TO SEND <br />COMMENTS SHOULD HAVE BEEN 20 DAYS AFTER THAT OR JULY 18, 2003. <br />Rather than require Cheyenne County, to republish again and start the process, we request that you send a <br />written waiver extending the Decision date to September 10,2003. If the written waiver is not received prior <br />to the decision date, the Amendment application could be denied. <br />III) EXHIBIT "Q" proof OF Mailing of Notices to County Commissioners and Conservation District. <br />A) The headings on the Notices refer to a Special 111 permit, while the narrative refers to a regulaz 112 <br />application.
