Rationale for Approval Recommendation May 20, 2002 <br />Four Comers Materials, Inc. <br />AM-01, Thomas Pit. Permit No. M-1976-020 <br />La Plata Soil Conservation District, Board of Supervisors; <br />State Board of Land Commissioners, Colorado Department of Natural Resources; <br />Colorado Division of Wildlife, West Regional Service Center; <br />Colorado Historical Society, The Colorado History Museum; <br />Air Pollution Control Division, Colorado Department of Public Health and <br />Environment; <br />Water Pollution Control Division, Colorado Department of Public Health and <br />Environment; <br />Division of Water Resources, Colorado Department of Natural Resources; and <br />U.S. Army Corps of Engineers, Sacramento District. <br />The applicant published public notice of the application in a local newspaper on February <br />26, 2002, March 5, 2002, March 12, 2002 and March 19, 2002. <br />On March 4, 2002, the applicant provided notice of AM-01 to the following surface and <br />subsurface owners of the affected lands: <br />Bryce Family Partnership, c/o Donna Thompson; and <br />Coleen J. Bryce. <br />Note: Right of entry is provided through fully executed lease agreement with <br />Donna Thompson and Coleen Bryce. <br />On March 4, 2002, the applicant also provided notice of AM-01 to the following surface <br />owners, who own lands within 200 feet of the affected land boundaries: <br />Milan J. & Virginia E. McMannis; <br />Terry W. Miller & Tammy Thompson; <br />James A. & Lavone Bryce; <br />The Ranch Development Company, Inc.; <br />Richard W. & Rebecca A. Mayo; <br />Ritz Family Trust; and <br />W. Jeffery & Annette Torrence. <br />Proof of notice, in the form of certified mail return receipts, has been received for all <br />landowners of the affected lands and landowners of lands within 200 feet of the affected <br />area boundary exceat for Ritz Family Trust. Notice to Ritz Family Trust was returned by <br />the Postal Service because the notice remained unclaimed. However, timely objection to <br />AM-01 has been received from Ronald G. Ritz. Issues raised by Mr. Ritz were considered <br />by DMG in it's review of AM-01. <br />The applicant provided copy of the two technical revisions to AM-01 to the La Plata <br />County Clerk and Recorder's Office on the same date the revisions were filed with DMG. <br />Copy of applicant's response to DMG adequacy issues were also provided to the Clerk <br />and Recorder's Office. <br />3 <br />
