Comments re/sting to dust exhaust and air po//ution. /Piercel
The Act and Rules do not specifically address air pollution issues. Please direct such
comments to the Air Pollution Control Division with the Colorado Department of Public
Health and Environment.
The Act and Rules authorize DMG to address stabilization of reclaimed areas for wind
erosion. However, DMG does not enforce the air quality standards for the dust resulting
from wind erosion.
20. Comments re/sting to traffic safety and impact to pub/ic roads. /Pierce)
The Act and Rules do not specifically address traffic safety issues or issues relating to
impact to roads not located within the boundary of affected lands.
27. Comments indicating opposition to any in-stream mining. Comments
suggesting that mining activity in the Animas River va//ey shou/d be curtai/ed or
e/iminated in its entirety. /McMannis, Ritz)
The Act and Rules do not exclude mining activities from river and/or floodplain areas,
except to the extent that such areas are located on lands covered under C.R.S. 34-32.5-
115~4)~f1. As stated previously, the Act and Rules anticipate that private and public lands
will be affected where mineable resources exist. However, the Act and Rules provide
reclamation requirements to ensure that affected lands are reclaimed to a use beneficial to
the people of this state.
12
