Rationale for Approval Recommendation May 20, 2002 <br />Four Corners Materials, Inc. <br />AM-01. Thomas Pit. Permit No. M-1976-020 <br />Durango at 701 Camino del Rio, Room 125, Durango, CO 81301, phone (970) 247- <br />5469. <br />13. Comments indicating a concern for potentia/ contamination from disturbing <br />the previous septic co/%ction ponds. (Ritz, Mayo) <br />The permitting authority for sewage treatment facilities is the Colorado Department of <br />Public Health and Environment (CDPHE-. On February 20, 2002, DMG noticed the <br />CDPHE of the application. Additionally, the applicant has informed CDPHE of the <br />abandoned facility and requested CDPHE assistance and/or recommendations for removal <br />of the ponds. The applicant has affirmatively committed to complying with any and all <br />requirements of the CDPHE regarding the abandoned sewage treatment ponds. The <br />application clarifies that discharge from the site will occur in accordance with the required <br />CDPHE discharge permit. The application satisfies the requirements of Rule 6.4.7 and <br />6.4.13. <br />14. Comments regarding cumu/ative impact of mu/tip/e in-stream permits. <br />Requests for a comprehensive p/an for 20 yeas permits for this and a//other pits <br />between Bakers Bridge and Tiimb/e Lane must occur before more permits are <br />issued. (Mayo) <br />The Act and Rules do not specifically address cumulative impacts from multiple <br />operations. Each application is reviewed individually and approved or denied based upon <br />its compliance with the minimum requirements of the Act and Rules. Additionally, the <br />Act and Rules do not specifically address concentration or close proximity of mining <br />operations. The Act and Rules anticipate that public and private lands will be affected <br />where mineable resources exist. However, the Act and Rules provide reclamation <br />requirements to ensure that affected lands are reclaimed to a beneficial land use. <br />15.
