Long <br />Division Director <br />On May 15, 2002, DMG issued its recommendation for approval of the application for <br />amendment number 001 (AM-01) to the Thomas Pit reclamation permit, over objections. <br />This document is intended to explain the process by which DMG arrived at its approval <br />recommendation over objections. <br />The application for AM-01 to the Thomas Pit permit was filed with DMG on February 15, <br />2002. The application proposes a 5 acre increase to the permit area to result in a total <br />permit area of approximately 35 acres. The proposed 5 acre expansion will contain a <br />surface sand and gravel extraction site located adjacent to the Animas River and within <br />the 100 year floodplain of the river. The 5 acre area will be reclaimed as a pond to <br />support wildlife habitat post mining land use. <br />Objections Received <br />The public comment period for AM-01 closed on April 8, 2002. During the public <br />comment period, DMG received written objections from the following: <br />1. John Ott, President of Animas Consolidated Ditch Company, <br />dated March 27, 2002, DMG received March 28, 2002; <br />2. Dennis Pierce, dated March 29, 2002, DMG received April 1, 2002; <br />3. Ronald G. Ritz, M.D., dated April 1, 2002, DMG received on April 2, 2002; <br />4. Rick W. Mayo, dated March 30, 2002, DMG received April 5, 2002; <br />5. Jennifer and Joseph Wheeling, dated April 4, 2002, DMG received April 5, 2002; <br />6. W. Jeffrey Torrence, dated April 2, 2002, DMG received April 8, 2002; <br />
