These features re-set the decision date clock and the Board's hearing date per <br />Rule 1.4.9(3). <br />The Division considered convenience to the objectors, timeliness, the rules, the <br />Act, and the Operator's waiver of 90-day notice in establishing a Division <br />decision date of February 14, 2005, which is one day before the first scheduled <br />Board hearing date. This allowed the Division and the operator time to prepare <br />for the board hearing; it provided the objectors the full statutory review period; it <br />accommodated a holiday work schedule; and it provided for a decision between <br />the 90th and 120th day from the new publication date. We recognize why this <br />might appear confusing. <br />This letter is provided for the convenience of all objecting parties to explain our <br />rationale for the Decision Date.
