(8) It is understood by the operator/applicant that planting required for reGamation <br />may be delayed, through the period of use related to places of refuse disposal, <br />haulage roads, and road cuts. All industry standards for such storage will be used to <br />stabilize the surfaces. The operator/applicant is aware that no planting is required on <br />these areas, as follows: <br />(a) on any affected land being used or proposed for the deposit or disposal of <br />refuse until after the cessation of operations for productive use of such refuse;. <br />(b) on lands proposed for future mining; <br />(c) within depressed haulage roads or final cuts while such roads or final cuts <br />are being used or made. <br />(d) where permanent pools or lakes have been formed; and <br />(e) on any affected land so long as chemical and physical characteristics of the <br />surface and immediately underlying materials of such affected land are toxic, deficient <br />in plant nutrients, or composed of sand, gravel, shall feasibly be remedied by <br />chemical treatment, fertilization, replacement of overburden, or like measures. <br />(9) The operator understands that where adverse characteristics of the surtace exist, <br />and it is not feasible to remedy by artificial measures, that substitute acres may be <br />reclaimed. <br />3.1.11 Buildings and Structures <br />This site is privately owned, and does not fail under the State Historic Preservation <br />Office Requirements for a cultural or history study, however, there is no cause to <br />believe there are any areas of interest to be mined. If the operator uncovers any site, <br />the State Historic Preservation Office will be notified. <br />There are no structures except for ranch fences presently on site, nor are there any <br />permanent structures planned for this site. Hermit Road (CR 160) is immediately to <br />the south of the site. <br />3.1.12 Signs & Markers <br />(1) The operator will post a sign which will be clearly visible from the access road with <br />the following information addressed: <br />(a) The name of the operator; <br />
