Cattany <br />Acting Division Director <br />Sec erc~ ~/ <br />RE: Shavano Gravel Pit, Permit No. M-1983-208, Amendment No. 1 / Adequacy Review <br />Dear Mr. Conger: <br />DMG has completed review of your response to the preliminary adequacy review of your application for <br />an amendment to Permit No. M-1983-208 for the Shavano Gravel Pit. The application cannot be <br />approved until the remaining issues listed below are adequately addressed. Please submit a response <br />to the following issues as soon as possible, but no later than October 15, 2002 so the decision due date <br />set for October 21, 2002 can be met. If you cannot respond by October 15, 2002, please submit a <br />written request for extension of the decision date. If your response, or an extension request, are not <br />received by October 15, 2002 this application may be denied. <br />ADEQUACY ISSUES <br />Exhibit C -Mining Plan Mao <br />1. Please verify the landowner for the parcel that ties northwest of the point of beginning of the legal <br />description to ensure all required parties have received notification. Also please add the water line <br />in Poplar Road to the permit maps and specify the owner of the water line. <br />2. Response acceptable. <br />3. As previously stated, if the mining plan is to result in a near flat pit floor, it would follow that the <br />areas to be daylighted would have an excavation limit that follows the contour of the daylighted <br />slope. Please correct this apparent discrepancy for the southeast corner of the site on Exhibit C <br />and Exhibit F. <br />Exhibit D - Mining Plan <br />4. Damage waivers provided for structures listed in Exhibit S must be notarized per Rule 6.4.19(a). <br />Please re-submit damage waivers that have been properly notarized. Please ensure these <br />agreements are specific and detailed about what number and what type of structures are addressed <br />by the agreement (to protect both parties). <br />5. Asphalt production generally involves the use of hazardous materials (not waste). These materials <br />may include diesel fuel storage for generator fuel or additive chemicals sometimes used in asphalt <br />production. Please address spill containment for any hazardous material that is proposed to be <br />
