MEMO <br />INFORMATION, MINERALS PROGRAM <br />TO: Whom It May Concern <br />FROM: The Division of Minerals and Geology <br />DATE: October 2, 2001 <br />RE: Citizen Participation in the 112 Reclamation Permit Application Process <br />Revised October 19, 2001 and August 2, 2004 <br />INTRODUCTION: <br />Thank you for taking the time to be involved in the State of Colorado's process of <br />reviewing applications for new (or revisions to existing) n"n~ng operations. The <br />purpose of this memo is to explain the 112 Reclamation Permit application <br />process, your rights as either a party or a non-party, and the jurisdiction of the <br />Mined Land Reclamation Board (Boazd). The Office and Board operate under the <br />provision of the Construction Materials Act (Act), if the application is for the <br />extraction of construction materials. We operate under the Hazdrock Act (Act), if <br />the application is for the extraction ofnon-construction materials. <br />If an application for 112 Reclamation permit for a Construction Materials or <br />Hazdrock operation is approved by the Board or Office, the approved permit is for <br />the life of the mining operation (Life of Mine) since our permits have no expiration <br />date. The permit may be revoked and the reclamation bond forfeited to the State <br />only by an action of the Mined Land Reclamation Boazd. Revocation and <br />forfeiture may occur due to an uncorrected violation of the Act, Rules and <br />Regulations, or the terms of the approved permit. <br />THE MIlVED LAND RECLAMATION BOARD BOARD): <br />1 <br />
