available topsoil would cover that 146 acres to approximately .59 feet or about 9.1
inches in thickness. Given the inherent inaccuracy of construction equipment in
salvaging and respreading topsoil material,the inherent generality of Order 3 soil survey
descriptions and the nature of topsoil to compact with handling, this is consistent with
the amount of topsoil that has been replaced and still exists on site in stockpiles.
The Division believes that, if the operator accepts the condition suggested by the
Division in a letter to the operator dated June 4, 1997, the amendment will contain
adequate requirements so that the reclamation plan has a reasonable chance to meet the
stated end land uses of wildlife habitat and general agriculture. In any case, the operator
will have to meet the requirements of Section 34-32.5-116(4)(f) and Rule 3.1.10 prior
to reclamation responsibility release.
