On September 9, 2003, the Division of Minerals and GcologV received your 112 Construction Materials
Reckvnation Permit Amendment Application package for the Durham Sand & Gravel Pit, Permit No. M-1978-
056. Preliminary review of the information received determined that the following items must be received before
the Division can consider your application as being submitted and technical review can begin:
APPi.iC'ATIt)y FnRM~ Since the Permit, the Financial Warranh~ and the Performance Warranty for
the Durham Sand R Gravel Pit, Permit No. M-1978-056, are site specific legal documents t}me Division
requires Varra Companies, Inc. to do either a Succession of Operators to change the site name to the new
name of Durlmam -Resource Recovery & Land Development Project or you may wish to change the name
back to the original name of Durham Sand & Gravel Pit, wherever necessary, in all of the copies of
Amendment Application. The cost of the Succession of Operators application is $125.00. If you decide
to do the Succession of Operators application you will need to submit a new properly executed Financial
Warranh~ and Performance Warranh~ in the new site name. Forms are enclosed for your use.

sufficient to demoustmte tlmat the stability of any strctures located within tmvo hundred (200) feet of the
operation or affected land W~11 not be adversely affected. Tlme Division cvumo[ accept the Engineering
statement found on the "Protection of Existing Facilities for Proposed Varra Gravel PiY' map. The
Division can accept one or all of [he following:
l). A signed notarized statement from the Operator stating that you will stay at (cast 200 feet away
from the Man-made strctures until an agreement can be reached and copies of the agreements are
submitted to the Division;
2). Provide copies of agreements with the oW'ners of the Man-made strctures; and/or,
3). Provide an Engineering demonstration (not a statement).

Materials.
