Box 3345
Durango, CO 81302
Caplets County Planning Department
1060 Bast Second Avenue
Durango, CO 81301
March 27, 2002
Dear Sir or Madam,
pp~~~~ a~„~
-~~~'`00 of~e des eOG~o/
o9Y
~~
Op
y
The plans to restart mining in the Thomas gravel pit have come to our attention. The Animas Consolidated
Ditch Company was not notified of these plans or asked for comment, as we should have been, since the
ditch is on the west boundary of the permit area. The ditch company aggressively protects easements and
resists encroachments along the ditch bank. We would like to be informed of all planned activity that could
affect the ditch.
We have two concerns about this proposed mining:
• Water from the Animas Consolidated Ditch cannot be used for mining, and can only be used for
agricultural purposes.
• The ditch cempauy is aware that our diversion must be cleared periodically from natural erosion,
but we are extremely concerned that the proposed plans for the mining would compromise the
ditch diversion through headword erosion. If this should happen, the ditch company wilt bold
the mine operators responsible for mitigating and correcting the problem. The proposed
mine operators should be made fully aware of this.
Should you have any questions, please contact me at 259-7048 or 749-7795.
Thank yon,
~~
hn Ott, President
Animas Consolidated Ditch Company
~~
~, ;
